This General Terms and Conditions policy represents the updated form of the terms and conditions that regulate the relationships established between INTERGENERATIONAL AND CROSS-CULTURAL CAREER HUB (ICCAREERHUB) and Users arising from or in close connection with the use of the ICCAREERHUB Platform.
The ICCAREERHUB platform is developed and managed by the INTERGENERATIONAL AND CROSS-CULTURAL CAREER HUB association, registered with the Special Register under no. 129 of 03.10.2023, fiscal registration code 48976102, headquartered in Cluj-Napoca, Str. Dunarii, No. 142, Staircase 1, Floor 1, App. 5.
ICCAREERHUB's mission is to assist and guide children aged 11-18, their parents and adults in the process of discovering their natural inclinations and building a career that aligns with their personal values. We do this by providing and delivering practical programs and workshops, as well as by organizing special meetings with potential employers.
By creating a Student or Instructor account on the platform and by any use or access to the ICCAREERHUB Platform, Users agree to comply with the General Terms and Conditions and all Annexes that form part of it, respectively:
ANNEX Privacy and Cookies Policy
For the purpose of alternative dispute resolution or for any other notification in order to protect the rights and interests of consumers, any interested person may submit a written notification to the Alternative Dispute Resolution Directorate of the National Authority for Consumer Protection, respectively, at the following contact details: Bucharest, Bulevardul Aviatorilor no. 72, sector 1, postal code 011865, tel: 021.307.67.69; fax: 021.314.34.62, e-mail: dsal@anpc.ro. - Defining some terms
Within the General Terms and Conditions, all Annexes thereto, as well as within the concrete use of the ICCAREERHUB Platform, the terms presented below will have the corresponding meaning presented below:
1.1 "ICCAREERHUB" shall mean the association INTERGENERATIONAL AND CROSS-CULTURAL CAREER HUB (HUB DE CARIERA INTERGENERATIONALSI INTERCULTURAL), registered in the Special Register under no. 129 of 03.10.2023, fiscal registration code 48976102, headquartered in Cluj-Napoca, Str. Dunarii, No. 142, Staircase 1, Floor 1, App. 5, which can be contacted by electronic correspondence at the e-mail address info@iccareerhub.com;
1.2 The "ICCAREERHUB Platform" shall mean the website accessible at https://iccareerhub.com/ owned and managed by INTERGENERATIONAL AND CROSS-CULTURAL CAREER HUB through which Users will have access to the Service provided by ICCAREERHUB;
1.3 The "Service Provided or ICCAREERHUB Service" shall mean the intermediation service provided through the ICCAREERHUB Platform consisting of the promotion and distribution of Services, Mentoring and Coaching sessions, Programs or Events for career guidance and/or personal development, created and supported by ICCAREERHUB, respectively, the purchase, viewing and benefiting of career guidance and/or personal development services by Learners, as well as any other facilities made available to Users through the ICCAREERHUB Platform interface;
1.4 "Users" shall mean both Learner users and Instructor users, as well as any natural or legal person who uses the ICCAREERHUB Platform even by simply accessing the domain www.iccareerhub.com
1.5 "Student" shall mean the User who uses the services intended for the Student Profile, represented mainly by purchasing and viewing Programs as well as the other options presented in the Annex General Instructions for Use Chapter I - Student Profile. To remove any doubt, the User who has created an Instructor account will be considered a Student when using the services intended for him, namely purchasing and viewing Programs;
1.6 "Instructor" shall mean the User who uses the services intended for the Instructor Profile, represented mainly by the creation and loading of Programs as well as the other options presented in the Annex General Instructions for Use Chapter II - Instructor Profile;
1.7 "Courses" shall mean scientific or specialized technical or artistic educational material created for educational purposes, produced or uploaded by the Instructor and offered for purchase to Learners through the ICCAREERHUB Platform;
1.8 "User Account" shall mean the Profile created by the User who wishes to use the ICCAREERHUB services by completing the account creation procedure within the ICCAREERHUB Platform;
1.9 The "ICCAREERHUB Ethics Policy" shall mean the standards of integrity and the prohibition of the acts listed or described in Subsection 5 entitled "Ethics Policy";
1.10 The "ICCAREERHUB Promotional Policy" shall mean the limited way in which ICCAREERHUB may intervene within a promotional campaign on the selling price established by the Instructor for a Course as established in the Annex Specific Terms for Instructors.
- User Account
2.1 The User is obliged to truthfully declare all mandatory information requested at the time of creating the User Account.
2.2 The User, a natural person, declares by creating the User Account that he has full legal capacity and is able to assume in his own name the rights and obligations arising from the use of the ICCAREERHUB Platform and from the purchase of the ICCAREERHUB service in relation to the national legislation applicable to the User.
2.3 ICCAREERHUB may condition the creation of the user's account as a Learner or Instructor on certain information or the acceptance of certain specific conditions. The user guarantees the conformity of the information declared in relation to the creation of the account and the use of the ICCAREERHUB service and will immediately inform ICCAREERHUB of any change to this information. In this regard, any change that has not been communicated to ICCAREERHUB will be declared unenforceable against it and against its commercial partners.
2.3 The User is solely responsible for choosing and disclosing the access password and is liable for any activity and/or transaction carried out through the User's Account, meaning that the creator of the Account will be liable for any activity undertaken or damage caused through the created profile, in this regard, the use of the Profile by a third party cannot be opposed to ICCAREERHUB or other Users of the ICCAREERHUB Platform.
2.4 In case of suspicion that another person is using his/her Profile, the User holder will immediately inform ICCAREERHUB, which will provide the necessary assistance under the condition that the User unequivocally proves his/her capacity as the account holder.
2.5 ICCAREERHUB will not be held liable for damages caused to the User by the actions of other persons who access his account without permission.
2.6 ICCAREERHUB is entitled to limit or restrict the User's access to his/her account or to certain applications or functions of the ICCAREERHUB Platform when the User violates the provisions of these General Terms and Conditions and any annexes thereto. In this regard, we reserve the right to revoke any right granted to access and use any content distributed through the ICCAREERHUB Platform at any time, if we decide or are obliged to disable access to the content for legal reasons or for violation of ethics and safety policies.
- Purchasing and Using Programs
3.1 When you purchase a Program, you receive from the Instructor who created the Program a non-exclusive and non-transferable right to view and review the Program purchased through the ICCAREERHUB Platform exclusively for personal, non-commercial and educational purposes.
3.2 ICCAREERHUB's objective is to ensure that Learners have access to the purchased Programs for a period of 18 (eighteen) months, guaranteeing access to the purchased Programs for a period of 18 (eighteen) months from the time of completion of the program. The guarantee period concerns exclusively access to the purchased Program without including other additional services or facilities associated with a program such as, but not limited to, the possibility of instructors to provide assistance or question and answer services regarding the content of the Program, these services being able to terminate unilaterally and unconditionally by the exclusive will of the Instructor.
3.3 ICCAREERHUB will grant Students access to the purchased Program immediately upon payment of the purchase price displayed on the ICCAREERHUB Platform, but the content of the sessions will be accessible once the program begins. ICCAREERHUB will try to ensure that Students have the possibility of accessing the purchased Program in a perpetual and uninterrupted manner. However, ICCAREERHUB will not guarantee Students permanent and uninterrupted access to the ICCAREERHUB Platform and, implicitly, to the purchased Programs, access may be limited due to objective situations or technological difficulties that would make, in a reasonable manner, the provision of the ICCAREERHUB Service impossible or excessively difficult. ICCAREERHUB may also limit Users' access to the Programs in the event of their violation of these General Terms and Conditions and the Annexes thereto.
3.4 The Instructor guarantees both to the Learners and to ICCAREERHUB that he has the right to distribute the Program. In this regard, ICCAREERHUB will not be held liable to Users for stopping or restricting the distribution or viewing of the Program in the event that these measures may be considered necessary or appropriate for legal reasons related to or closely related to the intellectual property rights related to the Program.
3.5 The components and prerogatives of the intellectual property rights related to the Program are and remain the property of the Instructor, meaning that all legal relationships arising from them are concluded directly between Instructors and Learners, the ICCAREERHUB Platform and Service being exclusively a method of intermediation of the conclusion of the distance contract between Instructors and Learners. For the avoidance of doubt, ICCAREERHUB does not own any rights in relation to the intellectual property rights related to the Programs, is not a party to their creation, has no direct way of controlling the content of the Programs and cannot offer any guarantee in relation to them.
3.6 By purchasing the Program, the Learner does not have the right to reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works, sublicense or copy in any form and by any means the Programs distributed through the ICCAREERHUB Platform or to use in any other manner the Programs distributed, other than to view them through the ICCAREERHUB Platform for personal, non-commercial and educational purposes.
3.7 Payment for the Program will be made through ICCAREERHUB partner payment service providers who will ensure the credit/debit operation and will keep the payment information safe. For the purpose of payment, the Learner guarantees the use of a valid payment method with which he is authorized to undertake it.
3.8 The price displayed on the ICCAREERHUB Platform will reflect the total price that will have to be paid by the Learner for the purchase of a Program, meaning that the displayed price will include any possible taxes or other fiscal or budgetary obligations related to the purchase of the Program or other amounts that would be due for the transaction through the ICCAREERHUB Platform. The price may be the subject of a promotional campaign according to ICCAREERHUB policies, which aspect will be reported in a loyal and faithful manner.
3.9 In exceptional and justified situations, in order to comply with legal provisions or court or jurisdictional decisions, ICCAREERHUB may stop viewing or accessing a purchased Program. In such a situation, which is considered by the parties to be a justifiable cause, ICCAREERHUB will not be responsible for any damage caused to the Learner from the cessation of distribution of the purchased Program, the latter being entitled to direct his claims against the Instructor or the person responsible for creating the situation that determined the cessation of distribution of the purchased Course.
- Ethics policy
4.1 The ICCAREERHUB Platform will be used only for legal purposes and in compliance with good morals. Users are solely responsible for the materials uploaded or information transmitted or messages posted through the ICCAREERHUB Platform. In this regard, users will ensure that the reviews, questions, posts, programs and other content they may upload or distribute are in accordance with the ICCAREERHUB Ethics Policy.
4.2 ICCAREERHUB has a zero tolerance policy towards any message, material or discriminatory behavior or harassment or aggression of any nature based on the criteria of race, citizenship, ethnicity, color, language, religion, social origin, genetic traits, sex, sexual orientation, age, disability, chronic illness, political or religious opinion or beliefs, membership in a disadvantaged category, and any incitement or support offered for the purpose of supporting the previously listed facts.
4.3 By using the ICCAREERHUB Platform Service, Users are prohibited from creating or distributing plagiarized materials or materials that could infringe the copyrights of third parties, or from pursuing purposes or acts prohibited by law, with the entire responsibility for knowledge of the law remaining with the Users.
4.4 Users will strive to maintain the content of the Programs and messages posted or distributed in the educational, scientific, artistic and self-improvement spheres in accordance with the ICCAREERHUB Mission. In this regard, Users are prohibited from posting or distributing content or messages with sexual, pornographic, vulgar or exclusively entertainment overtones.
4.5 Users are prohibited from using the ICCAREERHUB Platform for immoral or illicit purposes or using it to facilitate the commission of or complicity in acts that could constitute crimes or misdemeanors.
4.5 ICCAREERHUB encourages and supports Users to provide support in complying with ICCAREERHUB policies by bringing to their attention any uploaded or distributed materials or posts that may violate the ICCAREERHUB Ethics Policy. For this purpose, Users may notify ICCAREERHUB of this at any time through the ICCAREERHUB Platform or directly by electronic correspondence to the e-mail address info@iccareerhub.com
We recommend that by reporting a violation of the ICCAREERHUB Ethics Policies, you submit the materials or indicate the necessary information and sources that will contribute to the investigation of the situation complained of so that ICCAREERHUB is able to ascertain the existence and seriousness of the reported act.
ICCAREERHUB will evaluate in accordance with its own beliefs and procedures whether or not the reported act constitutes a violation of the ICCAREERHUB Ethics Policies, to establish its seriousness and the eventual sanction or measures ordered in relation to the reported act. In this regard, in relation to any notification regarding the violation of the ICCAREERHUB Ethics Policies, ICCAREERHUB is not obliged to take certain actions or apply certain sanctions and will not guarantee to Users that the notification submitted will be followed by certain predetermined measures.
4.5 Users notified by ICCAREERHUB through the ICCAREERHUB Platform or by electronic correspondence, regarding a possible violation of the ICCAREERHUB Ethics Policies, are required to comply with the requests addressed by ICCAREERHUB. Refusal to comply will entail the application of sanctions or the taking of other measures deemed by ICCAREERHUB to be necessary or sufficient to maintain compliance with the ICCAREERHUB Ethics Policies.
4.6 Violation of the ICCAREERHUB Ethics Policies may result, with or without prior notice, in the application of sanctions or other measures deemed necessary or appropriate by ICCAREERHUB to enforce compliance with the integrity standards of the ICCAREERHUB Ethics Policies or to sanction their violation. Such measures or sanctions may include, but are not limited to, the following:
Removing or ceasing the distribution of content that is not in compliance with the ICCAREERHUB Ethics Policy from the ICCAREERHUB Platform;
Limiting the User's access to certain services, facilities or functions of the ICCAREERHUB Platform for a determined or indefinite period;
Suspending or limiting the User's access to the Student/Instructor Profile or to certain fields, functions or facilities in this section for a specified or indefinite period;
Suspension of access, closure or deletion of the Profile used in the creation or distribution of non-compliant content or used to commit illicit or immoral acts.
4.7 ICCAREERHUBi reserves the right to notify the competent administrative or judicial bodies to the extent that there is suspicion of committing illicit acts or acts prohibited by law.
- Declarations and limitations of liability – by using the ICCAREERHUB Service and Platform, Users acknowledge, declare and accept the following:
ICCAREERHUB does not legally or scientifically review the information related to the Programs or the content distributed through the ICCAREERHUB Platform and does not exercise any editorial control over them, meaning that ICCAREERHUB does not guarantee in any way the certainty, validity, accuracy, conformity or veracity of the content;
ICCAREERHUB has no responsibility towards the User or third parties regarding the termination, limitation or suspension of the User's access to the ICCAREERHUB Platform or to certain services, functions or facilities thereof;
ICCAREERHUB is not liable for the acts of third parties who use, with or without right, the functions of the ICCAREERHUB Platform's Service through the use of the User Account or the My Profile subsection within the ICCAREERHUB Platform;
Instructors are personally responsible for fulfilling all fiscal or budgetary obligations incumbent upon them that derive from or are affected by or related to the trading of Programs through the ICCAREERHUB Service and Platform;
ICCAREERHUB does not own any intellectual property rights or any other rights related to the Courses, any legal relationship deriving from the distribution of the Courses through the ICCAREERHUB Platform being concluded directly between the Instructor and the User or third parties;
ICCAREERHUB reserves the right to use the content uploaded, published or distributed through the ICCAREERHUB Platform for advertising purposes and in a limited manner in accordance with the General Terms and Conditions and the Annexes thereto;
ICCAREERHUB will not guarantee the protection of intellectual property rights related to the Courses or other rights deriving from the content published or distributed through the ICCAREERHUB Platform or the rights related to third parties that may be affected by the content of the Programs and the ICAREERHUB Service;
Users may not use the ICCAREERHUB Service and Platform for purposes other than those for which it was created and as described in these General Terms and Conditions and the Annexes thereto;
ICCAREERHUB is not responsible for any links to other websites, for any facts resulting from accessing these links, including the collection of personal information by them;
The ICCAREERHUB service does not include a search engine that provides preference in relation to the priority highlighting of certain Programs or Instructors.
- Applicable law and final provisions
6.1 Applicable law
These General Terms and Conditions and any relationship established through the use of the ICCAREERHUB Platform Service or deriving from them will be governed by the laws of Romania.
These General Terms and Conditions and the Annexes thereto have the force of law against any User or third parties in relation to the Service and the ICCAREERHUB Platform or other aspects provided for by the provisions of the General Terms and Conditions.
6.2 Amicable resolution of disagreements
Any misunderstandings, disagreements or prejudicial facts arising in connection with or deriving from the ICCAREERHUB Service and Platform that are directed against ICCAREERHUB will be resolved amicably by initiating negotiations on the part of the person making claims against ICCAREERHUB. If the parties do not reach a conciliation within 30 days of the initiation of negotiations, the entitled party may address the competent judicial courts from a material point of view within the area of which the main headquarters of ICCAREERHUB is located.
6.3 Notifications
Any notification, request or request addressed to ICCAREERHUB will be considered validly communicated only if they are transmitted through the specially designated functions within the ICCAREERHUB Platform, by electronic correspondence to the e-mail address info@iccareerhub.com or by postal service, by registered letter with acknowledgement of receipt and declared content or by courier ensuring the traceability of the correspondence, and is considered received by the recipient on the date mentioned by the receiving Post Office or, as the case may be, by courier to the address of the ICCAREERHUB head office located in Cluj-Napoca, Str. Dunarii, No. 142, 1st Staircase, 1st Floor, Apt. 5. To be valid, the communication must accurately include the identity of the sender and his/her contact address.
Any notification or communication sent from ICCAREERHUB to the User will be considered validly communicated if it is made through the ICCAREERHUB Platform or by electronic correspondence to the e-mail address indicated by the Users under the "My Profile" section.
6.4 Force Majeure
ICCAREERHUB shall not be held liable for the partial or total failure to perform the ICCAREERHUB Service, if this situation occurred as a result of force majeure, i.e. an extraordinary and insurmountable circumstance under normal conditions that could not reasonably have been foreseen and that occurred independently of the will of the parties and that prevents or makes excessively difficult the continuation of the provision of the ICCAREERHUB Service. Such a situation may be brought to the attention of all Users through the ICCAREERHUB domain or, separately, by electronic correspondence or by a message communicated through the ICCAREERHUB Platform.
6.5 Signing documents
Whenever it is necessary for Users to sign an act or document, in accordance with the General Terms and Conditions and their Annexes, when the law requires it or when ICCAREERHUB's commercial practice would make such a request, the document will be considered validly signed when it is signed either in handwriting or by applying an electronic signature chosen by the signatory and which meets the requirements provided by applicable legislation such as, but not limited to, Law No. 455 of 18 July 2001 on electronic signature and Regulation (EU) No. 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 199/93/EC.
6.6 The meaning of the terms used in the General Terms and Conditions and the Annexes thereto shall have the meaning defined by these General Terms and Conditions or, failing that, the meaning that is usually accepted in relation to the concrete context in which they are found. In case there are semantic differences between the meaning of the terms, in all cases, the meaning given by the Romanian version shall prevail.
6.7 Updates
ICCAREERHUB reserves the right to update and unilaterally modify these General Terms and Conditions to reflect the use of the ICCAREERHUB Platform and the commercial operation undertaken in particular by accessing the ICCAREERHUB Service in relation to commercial needs or legal requirements. Any modification of the General Terms and Conditions will be notified in advance either through the ICCAREERHUB Platform or by electronic correspondence sent to the address declared in the Learner or Instructor Profile indicating the date of entry into force.
6.8 Applicable version
The applicable version of the General Terms and Conditions is the one in force at the time of the occurrence of the event generating the legal relationship, such as, for example, the date of purchase of the Program for the rights and obligations arising therefrom. At the express request of the User, ICCAREERHUB will communicate to him the previous versions in force in relation to the specific date requested by the User.
6.9 The provisions of provisions 6.7 and 6.8 shall apply accordingly in the event of modification of the Annexes to the General Terms and Conditions.
